<p>This change, which takes effect from June 2010, has been made  to ensure that existing users of Link.net continue to receive dedicated support  for existing Link.net systems. In moving client support arrangements from CDVI  to AccessIT Data there will be no interruption to existing systems.</p>

<p>A serious explosion at a waste oil storage depot happened because the “site operator lost control of what its contractor was doing”, according to the HSE’s investigating inspector.</p>
<p>The failings, which led to the prosecution of Kent-based Eco-Oil Ltd and its managing director, resulted in a large explosion and fire as contract worker Michael White was welding on top of an oil storage tank roof in 2007. HSE inspector David Gregory said it was “miraculous” that White, who suffered minor injuries, was not killed.</p>
<p>Maidstone Crown Court recently fined Eco-Oil £125,000 plus £20,000 costs after it admitted charges under Sections 2(1) and 3(1) of the Health and Safety at Work Act for failing to protect employees and non-employees. MD Ian Cross was fined £5,000 with £500 costs.</p>

The recent prosecutions of waste management companies, Veolia Environmental Services and Biffa have highlighted the need for a more rigorous approach to contractor management and the safety of contractors on site.</p>
<p>With many companies across the waste sector considering plans to develop new facilities such as MRFs and energy from waste plants, businesses need to consider the importance of contractor management whilst undertaking new build programmes. However, the responsibilities of contractor management are not restricted solely to construction and installation projects. Businesses often employ regular contractors for routine maintenance, testing equipment and cleaning services to name but a few. Then there is the safety of visitors to site, for meetings, collections and deliveries.</p>
<p>In these highly regulated health and safety conscious times, all organisations employing contractors on site must, apply, follow and document their procedures for on site contractors. It is the responsibility of the contracting company to ensure that there is an audit trail of all contractor activity on site and that all rules and regulations regarding the management of a contractor are complied with. So whatever the need to employ contractors, whether it is a new build project, the installation of new plant and equipment or cleaning services a full audit trail of activity must be recorded. It could be the key to avoid future costly litigation cases if brought against the employer.</p>
<p>All companies appointing contractors to undertake work on their behalf have legal responsibilities for the health, safety and security of contractors whilst on site. There is a raft of legislation to consider and comply with, much of which stems from the Health and Safety at Work Act 1974. This Act leaves employers with no choice but to ensure, so far as is reasonably practicable, the health and safety of their employees and other people at work on their site, including contractors and members of the public who may be affected by their work. To meet these legal duties, employers and contractors need to work closely together to agree the methods and systems of work. There are also a number of related regulations which apply to contractors and provide guidance on the use of working platforms, provision of safety or guard rails, lifting equipment and welfare facilities. There really is much to consider, so what should companies be considering when employing contractors on site?</p>
<p>A good starting point is to appoint a project coordinator who is familiar with health, safety and environmental requirements and it should be clear where the lines of responsibility lie between the company and the contractor. There are different regulations for workers undertaking maintenance or construction type projects and the contractor being engaged should be familiar with the respective requirements for health, safety and security requirements whilst on site. The contractor should also ensure that the personnel being contracted to undertake the project or task are trained and compliant with the appropriate standard.</p>
<p>All contractor employees should receive a full site induction briefing prior to commencing work on site, which would highlight all risks likely to be encountered. Once fully trained and briefed and key documents such as risk assessments, method statements, permits to work and emergency procedures are agreed and issued, the contractor will be authorised to commence work. However, management of contractors on site is a continuous process which must be reviewed regularly throughout the project, right through to its completion, as different tasks and requirements will be needed throughout the project.</p>

<p>Whilst efforts across the sector in recent years to reduce incident rates in such areas as slips, trips and falls has not gone unnoticed, employers will do well to ensure the appropriate systems and procedures are in place when employing contractors within their business or on current or forthcoming projects.</p>
